New Jersey lawmakers have passed sweeping new legislation the allows the use of design-build for all state and local governments. The bill passed both the House and Senate by overwhelming margins and now awaits the governor’s signature. New Jersey bill A1285 allows that any independent state transportation authority with an established prequalification, project rating, or proposal process for design-build contracts in place may continue to award design-build contracts pursuant to that process. Design-Build for local government or public school contracting units is limited to projects exceeding $5 million
Research shows design-build is the best performing delivery system for both schedule and cost and will deliver nearly half of all construction dollars this year and New Jersey now joins the majority of states with full or widely permitted design-build authorization. Only North Dakota and Iowa still prohibit the use of design-build. The timing is especially beneficial for New Jersey as Washington considers a multi-trillion dollars infrastructure investment plan. Design-build played a vital role in 2009 delivering projects through the American Recovery and Investment Act (ARRA) and is expected to, once again, be widely used by Owners to deliver projects quickly and efficiently in this recovery.
