Summary: Defines pipelines, excluding municipally owned natural gas pipelines, regulator stations for gas pipelines, gate stations for gas pipelines or meter assemblies for gas pipelines, as “horizontal construction,” while also pertaining to design-build and progressive design-build authorization for horizontal construction projects.
Design-Build Impact: The bill reaffirms the ability for procurement entities within the state to acquire design-build and progressive design-build services for projects which fall under the definition of “horizontal construction.” The bill sets a December 31, 2030 sunset for progressive design-build contracts for horizontal construction projects. The bill further reinforces Arizona’s design-build and progressive design-build authority, which will hopefully lead to more projects of both natures within the state.

Summary: The Charter School Transparency and Accountability Act proposes modifications to Arizona charter school regulations to address transparency, governance, and accountability requirements.
Design-Build Impact: School districts within the state will have to prepare or submit an annual report on the benefits associated with design-build use. The state board of education shall adopt, and the auditor general shall review, rules authorizing school districts to procure construction services by construction-manager-at-risk, design-build, qualified select bidders list and job-order-contracting methods of project delivery, creating a firmer outline around design-build use within the state’s education sector.

House Bill 2692: Construction Services

Summary: The bill directly addresses construction and procurement methods when it comes to design-build operations within the state.

House Bill 2873: Competitive Sealed Bidding Question and Answers

Summary: This bill proposes to amend Arizona procurement statutes relating to competitive sealed bidding procedures. The bill addresses question and answer periods for bidders and interested parties in the procurement process.
Design-Build Impact: For design-build construction services awarded by competitive sealed proposals, bid security shall be ten percent of the purchasing agency’s construction budget for the project as stated in the request for proposals, excluding finance services, maintenance services, operations services, design services, preconstruction services or any other related services included in the contract. This serves to further clarify the more technical guidelines for design-build projects within the state.
