The Design-Build Institute of America (DBIA) worked with the influential Virginia Transportation Construction Alliance (VTCA) to get ATCs codified into Virginia law.

Richmond, Va. – DBIA celebrated the codification of Senate Bill 465 in Virginia on Monday, March 21, which allows for design-build proposals to include Alternative Technical Concepts (ATCs), a recommended best practice in design-build project delivery for the transportation sector. Alternative Technical Concepts (ATCs) are technical ideas that are developed by proposers, typically during a design-build or Public-Private Partnership (P3) procurement, that deviate from the Request for Proposal (RFP) criteria for a given project. ATCs are allowed on design-build projects in neighboring North Carolina, which recently used an ATC on the I-485/I-85 project to achieve an impressive $30 million in cost savings.
“ATCs are a recommended best practice in the transportation sector because they allow for innovation, flexibility, time and cost savings on the design and construction while providing equal or greater value to the owner.” said Lisa Washington, CAE, who serves as Executive Director/CEO for DBIA. “Virginia was one of the very first states to authorize design-build for public projects, and we are ecstatic to see them continuing to set an example for how other states can achieve success in delivering innovative public infrastructure.”
Governor Terry McAuliffe (D) signed the legislation earlier this month after having passed both legislative chambers by unanimous approval.
